THE USE OF MATERIALS AND SERVICES OF FALIGI PUBLISHING HOUSE IS REGULATED BY THE FOLLOWING AGREEMENT.

THE USE OF THE SITE CONSTITUTES THE ACCEPTANCE OF THE FOLLOWING CONDITIONS.

1. Definitions and use
Faligi, with head office in Aosta Valley, Rue Amerique, 9 Quart 11020 Italy, P.IVA IT 01124850072, registered to the commercial registers 01124850072, REA AO - 69469 (from now on called "Faligi Edition”) authorizes the fruition of the services available in this Web site (from now on called “Site”) to a strictly private use, not to commercial ends, provided that the notifications on the Copyright and on other property rights stay enclosed to the original material copies.
The subject, physical or juridical person, accepting this agreement is thus authorized to enter the Site and benefit of the services here presented, will be from now on called "User”.
With the term "materials" we identify all contents (documents, images, photos, sounds, animations, software) and services presented on the Site.
The use of some materials and/or services presented on the Site is dependent on the ownership of requirements and/or on the fulfillment of subsequent obligations, in accordance with the respective sections of the Site indicated in this Agreement and dedicated to such services.
Whenever the User browses in the Site, he accepts to stick to laws of the agreement as established in the moment in which the logging occurs.
If the following specific conditions are not accepted the use of the site will not be allowed.

2. Object of the agreement
They constitute object of this Agreement services and contents presented in the Site in the state in which they are found in the moment in which you enter the Site, with the following clarifications:
(a) it does not constitute object of the agreement the continuous, periodic or constant supply of information and/or exhaustive, complete, defined, up-to-date services, exempt from vices, defects, mistakes, or of information and/or services finalized to a commercial and/or professional use;
(b) it does not constitute object of the agreement the achievement of purposes or particular results pursued by the User;
(c) it does not constitute object of the agreement the control of other sites where it is possible access through the links presented in this Site, neither the follow-up of the exactness and/or of the update of said links.

3. Execution of the agreement
Services and contents presented in the Site are provided in a single solution at the moment of each connection. By browsing in the Site the User accepts the immediate consignment.

4. Copyright, literary property
All documents, images, photos, sounds, animations, databases, softwares and every other material presented in the Site are object of intellectual and/or industrial property. Every act, done without Faligi Edition authorization but reserved to the holder of legal rights from the national and international laws on Author’s Right and Copyright, will be civilly and criminally indictable.
Except for the exceptions allowed by the law and by this Agreement, every act to exercise the economic or moral use rights reserved to the holder, without previous written consensus of Faligi Edition, is forbidden by any means.
As to the works presented in this Site the obligations deriving from the regulations on Author’s Right and on the connected legal rights are acquitted.

5. Brands, dominions and distinctive marks
The www.Faligi.eu dominion is a recorded dominion of Faligi Edition property. All legal rights are reserved. Brands, recorded or not, dominions, logos, titles and index and every other distinctive mark of Faligi Edition can be used exclusively with the previous written consensus of Faligi Edition. Every act, done without Faligi Edition authorization but reserved to the holder of legal rights from the national and international laws on brands and distinctive marks, will be civilly and criminally indictable.
All the other brands, recorded or not, names of products or services, dominions, denominations of enterprises or societies, logos and distinctive marks that appear in this Site belong to the respective holders. Faligi Edition is not authorized to allow, neither it allows, in any case the use to third parties.

6. Graphics, structure, technology and other protected elements
The graphics, structures and every other element of the Site are likewise protected by commercial and other laws. They cannot be copied, imitated, rebroadcasted or used, neither wholly nor partially, without the previous written consensus of Faligi Edition. Every act, done without Faligi Edition authorization but reserved to the holder of legal rights from the national and international laws, will be indictable civilly and criminally.

7. Solutions and services
The section "eLearning" is part of the innovative services offered by Faligi Edition. The User can benefit from such services according to the level of authorization and he can also, assuming exclusively every and any civil and criminal liability , browse the online contents, using the available resources and the active functionalities.

8. Limitations
It is not allowed to modify in any way the materials presented in the Site, neither reproduce nor transmit them publicly, execute them, distribute them nor use them in other ways with public or commercial ends. To the conditions presented, it is not allowed the use of the aforementioned materials on any other Web Site or network to any purpose. The mirroring of the Site is forbidden.

9. Prohibitions
It is forbidden to the User to input in the file server of Faligi Edition:
(a) personal details of third parties without juridical faculty;
(b) information or data covered by third parties legal rights, without juridical faculty;
(c) materials, information or data that damage third parties copyright, and among the other, the deceptive, offensive, slanderous, threatening, blasphemous, obscene, pornographic, racist ones that may cause damages, in any way, to young persons or in any case reprehensible;
(d) materials, information or illegitimate data, such as illegitimate activity through the Site.
It is likewise forbidden to Users to interfere with or interrupt the services provided by the Faligi Edition Site. The User assumes in exclusive way all legal and criminal liability, also toward Faligi Edition, for the downloading of any material that contains virus or other codes, files or programs created to interrupt, obliterate or limit the operation of the computer software, hardware or installations in general.
Faligi Edition reserves the legal right of not to publish and/or remove the contents that, to his unquestionable judgment and without constituting the assumption of any responsibility, are not appropriate to its publishing lines or do not correspond to the finalities or to the qualitative standards of the Site.

10. Regime of responsibility
All contents and services presented in this Site are provided in the state in which they are found, with all possible mistakes, defects or inaccuracies and without guarantees of any kind by Faligi Edition. Under no circumstances Faligi Edition or the authors of such contents and services can be considered responsible for the damages caused by the commitment of the user and/or third parties about completeness, precision, commercial or professional usability, updating, exemption from mistakes, flaws or defects of the contents and/or of the services presented in this Site. It does not constitute object of the agreement the control of sites in which it is possible to access through the links of this Site. Faligi Edition has not any power of any nature on aforesaid sites, neither it assumes therefore any responsibility on them.
It is our care to minimize the dysfunctions imputable to technical problems. Nonetheless part of these data or of the information presented in the Site have been input or structured in files or sizes that may not be exempt from mistakes. It does not constitute therefore object of the agreement the supply of a service that does not undergo interruptions or that it is not in any way prejudiced by such problems. With the plug in of the site contents, Faligi Edition does not intend to violate any Author’s Right, of industrial property or other laws. The input of the contents collected in the Site has been authorized by the holders of the legal rights, or it is free or concerning materials of public dominion. If it has been unintentionally put material on the Site without the consensus of the legal rights’ titular or in violation of the law, Faligi Edition will act in the terms of the law. Faligi Edition does not guarantee in any case the fruition exempt from disturbances and the non infringement of the copyright by third parties concerning the contents and/or the services presented in the Site. Information and activities of the Site do not want to be or constitute illicit in no way.
Faligi Edition is legally held to denounce to the competent authorities the presence in the Site of illegitimate information reported by third parties and/or the accomplishment by third parties of illegitimate act through this Site.
The User is the sole responsible for any damage, direct, indirect or consequent, deriving to the same User and/or to third parties following any form of use or lack of use, of information, data, materials and services presented in the Site. Faligi Edition is not responsible for the damages direct and indirect, included also, without restraint, the damages for loss or lack of earning, stop of the activity, economic or information losses, in any case suffered by the User and/or by third parties depending on the use, or the lacked use, of the Site and/or of all or of some of its contents and/or services.
Faligi Edition does not assume any responsibility in connection with the removal, the failed visualization or storage of any communication of the User (with particular, but not exclusive, reference to the supply of "contents and publishing innovative services"). The present clause regarding the regime of responsibility will not limit the responsibility of Faligi Edition if it can constitute violation of the dispositions of the national applicable laws, neither it excludes it in the cases in which it cannot be excluded in force of the aforesaid law.

11. Responsibility of the "User" for the use of password or authorization codes.
Any sections or services of this site are accessible or enjoyable with username, password and/or authorization codes. The User is obliged over Faligi Edition to keep to the highest diligence in the use and in the custody of username, password and authorization codes (in particular, but not exclusively, not to store them clearly in unguarded places or on the desktop of the computer or in the memory of the same computer) and it is therefore responsible for all consequences related to the possible unauthorized use of username, password or authorization code. Username, password and assigned authorization codes or reserved to the User are strictly personal and untransferable. In case of loss, theft or of well-grounded fear that your password or authorization code have come to knowledge of third parties, the user is held to give immediate communication to Faligi Edition so that it can take action, as soon as it is requested, for a new assignment. Faligi Edition reserves the faculty to suspend the authorization related to username, password or authorization codes until their restoration. Except for the mandatory laws, Faligi Edition is not in any case responsible for the damages that may derive to the User and/or to third parties for the improper use of username, password and authorization codes.

Faligi Edition reserves the faculty to suspend or rescind the authorization connected to username, password or authorization codes in case of violation of obligations assumed by the User according to this Agreement and to every other contractual disposition or law, general or special, of discipline of services provided by this Site.

12. Safety
Faligi Edition assures the secretiveness and the safety of all the contents of his administration. Our infrastructure of security network is protected by firewall. Data, online publications and annotations cannot be seen by anyone without username, password and the appropriate authorization codes. Password is an element of our security system. To buy in our site guarantees in addition the safety of the payment and the observance of the privacy law.

13. Safety of the payment
For purchasing effected through our Web site, in case of payment with credit card, the insertion of sensible data (nominative and credit card number) occurs in secure modality and with a total guarantee for the buyer. Faligi Edition uses, for the interbank transaction, the Sella Bank system that, receiving the credit card number of the customer through the SSL protocol (Secure Socket Layer) with 128 bit, guarantees the maximum data and communications security. Analogous protection is offered for payments effected with the personal credit system. The SSL is based on a system of cryptography that protects the content of the communications and/or authenticate the identity of the message sender. The addressee, using the same key or different in accordance with the systems, deals with the decoding of the encrypted message. With this method the seller never comes, in any way, to the knowledge of the credit card number of the buyer, receiving only the authorization to the bill acceptance furnished by the Bank. The time necessary for the transaction is approximately ten seconds. A short final message confirms the effected order.

14. Withdrawal Right
Faligi Edition guarantees that, in the case in which the received product does not correspond to the expectations, it is possible to change it or be refunded. The buyer, in this case, will return it to the sender within ten days of the date of the order, shipping charges are of the buyer's expense. In the case in which the product is damaged, or in case of delivery mistake, Faligi Edition take the necessary steps to the substitution in the briefest possible time, totally bearing the expenses on the restitution and the new dispatch of the product. Pay attention: this substitution will occur only and exclusively one time.

15. Variations to contents
Faligi Edition can modify in the course of the time the contents of this agreement, the continuous use of the Site constitutes acceptance of changes. Faligi Edition will try in any case to communicate, through the e-mail addresses in his possession, the substantial changes to the contents of this agreement.

17. Environmental declaration
Faligi Edition believes that environment qualities have to be considered as an essential characteristic in the quality of life and, hence, in the quality of economic development. Therefore makes its own the principles of the environmental protection and pursues the continuous improvement for the prevention of pollution. In particular, Faligi Edition intends to:
(a) observe the laws and all environmental regulations applicable to its own activities;
(b) pledge itself to produce and manage waste in such a way to privilege the recuperation and the recycling;
(c) promote the participation and the formation of the personnel in environmental subject;
(d) appraise the environmental meaningful aspects of goods and services used by the organization and communicate the requirements to suppliers.
(e) use papers without acids, with a neutral ph, realized with fibrous and virgin raw materials from renewable plantations and absolutely natural auxiliary products, non polluting and totally biodegradable.

18. Applicable law
This Agreement is submitted to the Italian law or to that of the country of the User if this imposes its application to ends of the recognition of the validity and/or of the effectiveness of the agreement.
If the user is a natural person that stipulates this Agreement for purposes distinct from the entrepreneurial or professional activity eventually performed ( namely a "User”), this Agreement is likewise disciplined by the legislative decree 22 May 1999. so far as applicable.

Legal right of author
To the senses of art. 1, paragraph 1 of the decree 22 March 2004., as modified from the law of conversion 21 May 2004 No. 128
For the works presented in this Site the obligations deriving from the regulations on the Author’s Right Law and on the connected legal rights has been acquitted.
The law 22 April 1941, n. 633 and following modifications sanction the specific violations to the Author’s Right Law and connected, among them the reproduction, the communication to the public, the availability of the public, the rental and the loan, the extraction, the re-employment, the public execution and the diffusion without the responsibility of legal rights holder.
To specific violations are applied the criminal punishments and/or administrative expected by the articles 171, 171-bis, 171-ter, 174-bis and 174-ter of the law 633/1941.
